<?_code
LJ::set_active_crumb('dmca');
_code?>
<?h1 What is DMCA? h1?>
<?p
The Digital Millenium Copyright Act (DMCA) was passed by Congress in October 1998. The purpose of DMCA is two-fold: it limits the liability of service providers whose users are infringing upon the copyright of others, and defines the procedures necessary to report such infringement.
p?>
<?h1 LiveJournal and DMCA h1?>
<?p
LiveJournal strives to protect the rights of copyright holders. For the purposes of compliance with the DMCA, LiveJournal's Designated Agent is the LiveJournal Abuse Team.
p?>
<?h1 Someone on LiveJournal is infringing upon my copyright! h1?>
<?p
Should you discover that a LiveJournal user is infringing upon your copyright, you may file official notification of such infringement. Upon receipt of a valid notification, LiveJournal will promptly take steps to disable access to the infringing material.
p?>
<?p
In order to be valid, a notification must include the following elements:
p?>
<ul>
<li>An electronic signature (your full legal name) of a person authorized to act on behalf of the copyright holder;</li>
<li>Identification of the copyrighted work claimed to have been infringed, in the form of the original URL of the image or work being infringed upon;</li>
<li>Identification of the material that is infringing upon your copyright, with reasonable information for LiveJournal to locate the material (you must include the username of the person who is infringing upon your copyright, and links to the allegedly infringing material);</li>
<li>Information reasonably sufficient for LiveJournal to contact you (a valid email address);</li>
<li>A statement that you in good faith believe that the material is not authorized for use in such a manner;</li>
<li>And finally, a statement, made under penalty of perjury, that the information given is accurate and you are authorized to act on behalf of the copyright holder.</li>
</ul>
<?p
This notification must be sent to the LiveJournal Abuse Team (LiveJournal's Designated Agent under the DMCA) to be processed. You may do so by visiting the <a href="http://www.livejournal.com/abuse/report.bml">Report Abuse</a> form and following the directions given there. Further information regarding LiveJournal's DMCA procedures may be found in <a href="http://www.livejournal.com/support/faqbrowse.bml?faqid=136">this FAQ</a>.
p?>
<?p
Please be aware that you could be liable for damages (which could also
include attorneys' fees) if you materially misrepresent a claim that
content is infringing upon your copyright. Note that in a recent case
(see <cite><a href="http://www.onlinepolicy.org/action/legpolicy/opg_v_diebold/">Online
Policy Group v. Diebold, Inc.</a></cite> for more details),
a company claimed their copyrighted material was being
infringed upon and sent notification requiring the removal of this
material. It was determined in court that the company knowingly and
materially misrepresented the claim, and as such was ordered to pay
damages and attorneys fees; the company has agreed to pay $125,000 in
total.
p?>
<?p
If you are not absolutely certain as to whether material present on
LiveJournal infringes upon your copyright, for example, if it may be
protected under exceptions to the copyright law, like fair use, it is
strongly recommended that you contact an attorney prior to submitting
any claim of copyright infringement.
p?>
<?p
Furthermore, if it comes to the attention of LiveJournal that any
material misrepresentation has occurred or is evident, LiveJournal
reserves the right to take any action it deems appropriate, in its sole
discretion, including, without limitation, suspending your account.
p?>
<?h1 What happens next? h1?>
<?p
Upon receipt of notification, the LiveJournal Abuse Team will take steps to disable access to the infringing material. However, if the user posting the content in violation believes they are authorized to use the material, they are entitled to file a counter-notification indicating this. In order to be valid, the counter-notification must include the following elements:
p?>
<ul>
<li>Your electronic signature (your full legal name);</li>
<li>Identification of the material in question, including the location at which the material appears;</li>
<li>A statement, made under penalty of perjury, that you have a good faith belief that the material in question was identified as a copyright violation as a result of mistake or misidentification, including the reasons why you believe this;</li>
<li>Your full name, address, and telephone number, along with a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the initial notification.</li>
</ul>
<?p
Following receipt of a counter-notification, the original notifier will be provided with a copy of the counter-notification. Access to the content will remain disabled. Unless the original notifier informs the LiveJournal Abuse Team that an action has been filed seeking a court order to restrict access to the content, the content will be replaced after 14 business days.

<?h1 Our Principles h1?>
<?p We at LiveJournal try to make our service a pleasant experience for our
users, so we've assembled a list of business principles that help guide our
operation of the LiveJournal service. p?>
<?h1 We operate the LiveJournal service with the following goals: h1?>
<dl class='gp'>
<dt>Work with the community, for the community</dt>
<dd>We will strive to keep you informed of changes to the best of our
abilities without being intrusive, and to run our business based on
feedback from the LiveJournal community, with the LiveJournal community's
best interests in mind.</dd>
<dt>Honor the status of every account</dt>
<dd>We fully intend to honor the status of our users' accounts, as
follows: Permanent accounts will be honored for the life of the
service. Paid accounts will remain as paid accounts until they expire,
unless they are renewed in advance. Early adopters will be granted access
to the paid features that were freely available in the early history of the
site. (Account status valid with the exception of account termination by
means of <a href="/legal/tos.bml">Terms of Service</a> violation.)</dd>
<dt>Maintain reliable uptime</dt>
<dd>We try to keep things running smoothly for everyone, especially since
we use the system, too. Unfortunately, server hangups do occur, but we will
plan ahead to try to avoid them.</dd>
<dt>Avoid banner advertisements</dt>
<dd>As it's one of our larger pet peeves, we have avoided putting banner
advertisements on the site. Although our Terms of Service permits us to
change our policy in the future, we've found throughout the past few years
that our "paid accounts" business model has, so far, made banners ads
unnecessary.</dd>
<dt>Avoid spam</dt>
<dd>We strongly believe that spam has no place on the internet, and
we endeavor not to send you e-mail without your implied or explicit
consent. When you sign up for the Service, we understand that to mean
you want to communicate with us and hear from us about our products and
services. If we do send you a message or contact you, we give you an option
to opt-out so that we won't send you similar messages in the future. We are
not in the business of selling lists of users' e-mail addresses or personal
information, though we may share users' information under certain special
circumstances, such as with an entity that owns or is owned by LiveJournal,
with our service providers and vendors in connection with the operation of
the service and our business, where we think it is appropriate or required
by law or to protect our legal rights, or if the business is being sold or
reorganized. (For more information on these special circumstances, click
<a href="/legal/privacy.bml">here</a>.)</dd>
<dt>Support the Free Software movement</dt>
<dd>We're big supporters of Open Source software - we have used it and
contributed to it extensively. As part of our contribution to the Open
Source community, we have made available to the public a large amount of
source code for software that we've used to run the LiveJournal service,
and that contributed source code will remain free and open. We plan to
continue to give back to the community by contributing certain bug fixes,
testing, documentation and new code. In addition, we continue to encourage
people to innovate using the open source code we have contributed.</dd>
